Abortion: not subject to prosecution in Austria if the expecting mother or the embryo is in danger of severe harm, if a minor is impregnated, or within the first three months of pregnancy after previous medical consultation (Abortion, Legal Limit for). In all other cases, premeditated termination of a pregnancy is a criminal offence in Austria under § 96 ff. of the Penal Code. Abortion is more severely punished when it is performed commercially, without the permission of the expecting mother or by someone other than a doctor, or if it results in the death of the mother.
